Terms of Service

Welcome to Visiting Card CRM. These Terms of Service ("Terms") govern your access to and use of our mobile application, web application, and any related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old (or 16 years old if you are in the European Union) to use the Service. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms.

2. Your Account

To use most features of the Service, you must sign in using a Google account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Ensuring the accuracy of information you provide
• Notifying us immediately at sayedurr607@gmail.com of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Your Content

You own your data. All contacts, collections, notes, reminders, and business card images you create or upload remain yours. We do not claim ownership of your content.

By using the Service, you grant us a limited license to:

• Store, process, and display your content to provide the Service
• Send your business card images to third-party OCR providers (Google Vision) for text extraction
• Send extracted text to third-party AI providers (Google Gemini) for structuring
• Sync data to your Google Contacts account when you enable sync

This license is only for the purpose of operating the Service and ends when you delete your content or your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload business cards or contacts you are not authorized to store
• Attempt to gain unauthorized access to other users' data
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service to send spam or unsolicited communications
• Interfere with or disrupt the Service or servers
• Upload viruses, malware, or any harmful code
• Violate any applicable laws, including data protection and privacy laws
• Use automated systems (bots, scrapers) to access the Service
• Resell, sublicense, or commercially exploit the Service without our written permission

5. Google Contacts Integration

Our Service offers an optional integration with Google Contacts. When you enable this:

• You grant us permission to read from and write to your Google Contacts using the Google People API
• This permission uses the scope https://www.googleapis.com/auth/contacts
• You can revoke this permission at any time from your Google Account settings
• Deleting your Visiting Card CRM account does not delete contacts from your Google account

You are solely responsible for the content of your Google Contacts and any changes you make through the Service.

6. Third-Party Services

The Service relies on third-party providers including Supabase, Google Cloud Vision, and Google Gemini. Your use of these services through our app is also subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of these third-party services.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect and use your information.

8. Intellectual Property

The Service, including its design, source code, logos, and content (excluding your data), is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not use our brand, logo, or trademarks without our prior written consent.

9. Service Availability

We aim to keep the Service available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance
• Third-party outages (Supabase, Google APIs)
• Network or connectivity issues
• Force majeure events

We are not liable for any losses resulting from Service unavailability.

10. Fees and Payment

The Service is currently provided free of charge. We reserve the right to introduce paid features or subscription plans in the future. If we do, we will notify you in advance and give you the option to opt out.

11. Termination

You may stop using the Service at any time and delete your account through the app or our Account Deletion page.

We may suspend or terminate your access to the Service if you:

• Violate these Terms
• Engage in abusive or illegal activity
• Attempt to harm the Service or other users

Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination — including intellectual property, disclaimers, and limitation of liability — will continue to apply.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Accuracy of OCR or AI-extracted contact data
• Fitness for a particular purpose
• Uninterrupted or error-free operation
• Freedom from harmful components

You are responsible for verifying any contact information before relying on it. We recommend reviewing OCR-extracted data before saving contacts.

13. Limitation of Liability

To the maximum extent permitted by law, Visiting Card CRM and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, contacts, or business opportunities
• Loss of revenue or profits
• Unauthorized access to your data caused by factors outside our control
• Errors in OCR or AI-extracted information

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Visiting Card CRM and its developers from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload or store through the Service

15. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Tamil Nadu, India.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by:

• Posting a notice within the app, and
• Updating the "Last updated" date on this page

Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
